辦簽證或是綠卡這種事，在其他公司通常是由人力資源部門來負責，我們公司卻由法務部門統一處理，我猜可能因為承辦人整天要跟移民律師打交道，講起那些艱深的法律術語，兩個都是搞法律的比較好溝通吧！不管，反正管他哪個部門的，能把我的簽證辦下來就行了！

十二月底的時候，Jenny（也就是我們公司負責辦理簽證的人）來電告知，當年份名額沒有了，要等明年四月申請明年的名額，她也發現這樣的話，我的簽證會有四個月的空窗期，於是再跟移民律師商量後，他們研擬了策略一，先為我申請J1 Trainee簽證來填補該段期間，之後再轉成H1B。

拿J1 Visa很麻煩，要先回台灣辦理一次，之後若是要轉成H1B，還得再出境一次。雖然手續繁雜，但是律師肯幫忙想辦法、公司願意出錢、我只需要填表格跟出個人，還抱怨啥呢？於是二月初大家便往這個方向分頭辦理。皇帝急死但太監不急，Jenny和律師都覺得我的簽證五月底才到期，還有三個多月的緩衝期，凡事以牛步的速度辦理。終於在三月底的時候，該來的文件終於讓我盼到了。公司請的移民律師果然經驗老到，既然我是以Trainee的身份申請J1，當然得附上我的學習課程表如下：

April - May 2006, Orientation:

·         Trainee will be met with her supervisor and other senior management and some of the firm’s staff.   

·         Trainee will receive training regarding the firm’s general office procedures and operations including tutorials in the administrative, technical, and business aspects of the company.  

August 2006 – December 2006, Financial and Market Research Development. 

·         The supervisor and other support staff will guide the trainee through financial and market research techniques used at the company as it relates to our investment products and services.  Throughout this segment of the training program, the trainee will be trained on how to create and maintain investment strategies that meet our clients’ goals, and prepare financial reports on economic relationships and market trends to submit to the supervisor for review.    

·         The supervisor will introduce the trainee to the company’s and the Asset Allocation Group’s corporate goals and objectives. The trainee will also be introduced to the company’s proprietary financial structures and products as well as to the company’s North American industrial client base.  In addition, the trainee will be trained on all of the necessary financial and statistical tools required to conduct financial research. 

·         The trainee will be trained on how to prepare and develop customized strategic asset allocation plans that meet our client’s investment needs.  The trainee will participate in Group meetings with the supervisor and other staff members to discuss various issues regarding asset allocation, products and services.  She will also have the opportunity to provide her own input and suggestions.

·         The trainee will accompany the supervisor to various events related to investment services and asset allocation such as business workshops, special events and conferences, as available.

January 2007 – May 2007, Account Database Development.

·         The trainee will learn and observe how to develop databases that are used to provide clients with accurate information regarding their asset allocation.  Basically, the trainee will learn how to create formulas and templates and prepare and maintain the databases.  She will also learn how to review and analyze portfolios and prepare comprehensive reports of our clients’ account holding activities and investment performances. 

洋洋灑灑的一大篇，真是超級酷的，這才發現原來我平常得做這麼多的事情，挺了不起的。不過就在簽完該簽名的部分，送上所有證明文件的兩天後，事情急轉而下。Jenny來電又來信地要我速速與他聯絡！ 

原來聰明的律師又想到別的辦法了，我們不要申請J1了！我們要辦綠卡了！綠卡？！這不是多少人夢寐以求的東西嗎？竟然從天上掉下來，白白送給我當禮物！不過先別高興，沒有一個公司不是精打細算的，不可能這樣就送我綠卡的，果然天下沒有白吃的午餐，這個綠卡只是用來填補六月到十月的那段空窗期，等到拿到H1B，綠卡當然還不可能下得來，奸詐的公司就會去撤銷申請。雖於覺得公司很小氣，但寄人籬下，公司願意想盡辦法幫你留下來，還有啥好抱怨的呢？所以還是乖乖聽律師的話，重新填了一堆繁雜的表格，雙手捧上所有的證明文件。

五月到了，距離被遣送回台的時間越來越近，但從送上所有文件後，全無Jenny的音訊，沒有消息是好消息？五月中，終於按耐不住，給她發了個EMAIL。果然凡事還是要自己提點注意，Jenny回信送來個好消息，四月送進去的H1B下來了！太好了，十月之後的身份有著落了！咦！但是六月到十月的咧？

等到火燒眉毛的五月二十五日，沒錯，距離OPT到期的前六天，收到了移民局來信要我去做指紋建檔。五月三十日，請假去了移民局壓了指紋。但做完指紋建檔，綠卡不可能個隔天就從天上掉下來啊！美國人的有時間是有名的，所以到三十一日到了，我當然還是沒有身份！OPT到期後依法還可在美國停留九十天，但能不能工作呢？那我得上班嗎？老闆當然希望我上班，至於律師，他批可（其實是違法的，後文說明），所以我也就繼續上班。直到六月二十二日，千盼萬盼，律師終於來信說，移民局已經在六月九日批准我的EAC（Employment Authorization Card），也就是說，從六月九日起我就有身份可以合法工作了。

有了等待綠卡申請的EDC當護身符，也就多了一年可以躺在美國高枕無憂，不過這張護身符只是障眼法，所以還是得回去申請那張已經核准下來的H1B。既然H1B是十月生效，律師要我早早去拿，以免夜長夢多，我也樂得趁此機會台灣吃喝玩樂一趟。所以在跟律師沙盤推演AIT移民官可能的各種問題後，我便在十月初回台申請H1B。

在跟律師推演的各個問題中，最重要的一項是，六月一日到六月九日這段期間有沒有上班？事實上，有！但正確回答是，沒有！有沒有領薪水，事實上，當然是有，要不然我做白工啊？但一定要回答，沒有。沒錯！我果然是當了九天的黑工！

不過來到了AIT，面試我的移民官倒是和藹可親，只問了一個問題，竟然問我的公司基金近來回報如何？害我悵然所失地反問他，沒有其他問題了嗎？他還沒來得及回答前，就咚咚咚蓋完所有印章，要我回家等簽證。從AIT出來後，上了貓空及深坑大吃大喝一趟，人還沒到家，爸媽就來電說，護照已經到家了！真是有柳暗花明又一村的感覺！

所以我現在拿的當然就是普通不過的H1B，至於綠卡，律師在確定我拿到H1B後，就撤銷申請了！也就是說，以後如果我想要在申請綠卡，還得從新再來過。不過，誰希罕呢！（完）
